Colorado Law Regarding Recorded Conversations

According to Colo. Rev. Stat. § 18-9-303, recording a conversation without the consent of at least one of the parties participating is illegal in Colorado.  According to Colorado Defense Specialist Michael Steinberg, doing so is punishable by a fine of $1000 to $100,000, and up to 18 months in prison.

Consent Requirements in Colorado

If you wish to record a conversation in Colorado, one or both parties must consent. No recording can legally be made unless at least one party gives consent regardless if the conversation is in person, on a phone, or electronic. Recording anyway is considered a criminal offense. If you are not involved in the conversation yet are listening to it, this is considered eavesdropping.

Legal Consequences in Colorado

If someone in Colorado feels you recorded them without consent, and that their right to privacy has been violated can hit you with a civil lawsuit. According to CriminalLawyerDenver.com, they can claim that the recording affected their reputation, caused emotional stress, or the recording invaded their privacy, and they could be entitled to compensation.
